The Activity consists of participation in an interactive slide and ball pit experience, including but not limited to: (a) use of an elevated slide structure approximately eight (8) feet in height; (b) entering, playing in, and exiting a ball pit filled with plastic balls; (c) interaction with other participants in a recreational setting; and (d) such other related activities as may be designated by event staff.

I acknowledge and understand that the Activity involves inherent and other risks, dangers, and hazards that may result in serious personal injury, permanent disability, paralysis, or death. These risks include, without limitation:

Physical Injury Risks: Falls from elevated surfaces, including the slide platform and slide itself; impact injuries from sliding, including but not limited to injuries to the back, neck, head, and extremities; collisions with other participants during slide use or in the ball pit; entrapment, suffocation, or breathing difficulties in the ball pit environment; cuts, bruises, abrasions, sprains, strains, fractures, and dislocations; head trauma, concussions, and traumatic brain injuries; spinal cord injuries resulting in paralysis; eye injuries from contact with equipment or other participants; aggravation or exacerbation of pre-existing medical conditions.

Environmental and Operational Risks: Equipment malfunction, failure, or inadequate maintenance; overcrowding and inadequate supervision; failure of safety equipment or protective barriers; slippery or unsafe surface conditions; inadequate emergency medical response; acts or omissions of other participants, event staff, or third parties.

Other Risks: Risks arising from my own physical condition, skill level, or judgment; risks from infectious diseases or communicable illnesses; risks that may not be reasonably foreseeable at this time.

I voluntarily seek to participate in the Activity. I have been given the opportunity to ask questions regarding the Activity and all such questions have been answered to my satisfaction. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ALL RISKS associated with my participation, WHETHER KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN, THAT MAY ARISE FROM ANY CAUSE WHATSOEVER, including but not limited to the negligence, gross negligence, or other fault of the Released Parties (as defined below).

I represent and warrant that:

1. I am physically and mentally capable of participating in the Activity.

2. I have no medical conditions, injuries, or disabilities that would prevent or limit safe participation.

3. I am not under the influence of alcohol, drugs, or any substance that would impair my judgment or physical capabilities.

4. I have disclosed all relevant medical conditions, medications, and physical limitations.

5. I will comply with all safety rules, instructions, and directions provided by event staff.

6. I will immediately cease participation and notify staff if I experience any injury or medical issue.

In consideration for being permitted to participate in the Activity, I hereby agree as follows:

A. Release of Claims — I VOLUNTARILY AND KNOWINGLY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the following parties (collectively, the “Released Parties”): Henkel Corporation, Henkel AG & Co. KGaA, and all related entities, subsidiaries, affiliates, successors, and assigns; Genesco Sports Enterprises, Inc. and all related entities; U.S. Soccer Federation, Inc. and all related entities; the venue owner, operator, and all related entities; all sponsors, co-sponsors, advertisers, and promotional partners; all respective officers, directors, shareholders, members, managers, employees, agents, representatives, contractors, subcontractors, volunteers, and insurers of the above entities.

B. Scope of Release — This release applies to ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, COSTS, EXPENSES, AND CAUSES OF ACTION (collectively, “Claims”) of every kind and nature whatsoever, WHETHER KNOWN OR UNKNOWN, ANTICIPATED OR UNANTICIPATED, SUSPECTED OR UNSUSPECTED, arising from, relating to, or in connection with my participation in the Activity, including but not limited to Claims for: personal injury, bodily injury, illness, disease, or death; property damage or loss; economic losses or damages; pain and suffering, emotional distress, or mental anguish; loss of consortium or companionship; punitive or exemplary damages.

C. Negligence and Fault Coverage — THIS RELEASE EXPRESSLY APPLIES TO CLAIMS ARISING FROM OR RELATING TO THE NEGLIGENCE, GROSS NEGLIGENCE, OR OTHER FAULT OF THE RELEASED PARTIES, except to the extent prohibited by applicable law. I understand that this means I am giving up my right to sue the Released Parties even if they are negligent or otherwise at fault.

I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all Claims, including reasonable attorneys’ fees and costs, arising from or relating to:

1. My participation in the Activity.

2. My violation of this Agreement.

3. My negligent or wrongful acts or omissions.

4. Claims brought by third parties arising from my participation.

I authorize the Released Parties and their designees to obtain emergency medical care for me if needed, including transportation to a medical facility. I acknowledge that the Released Parties assume no responsibility for the cost of such medical care. I waive any claim against the Released Parties arising from their decision to obtain or not obtain medical care.

I acknowledge that the Released Parties have not provided and are not obligated to provide insurance coverage for my participation. I am solely responsible for obtaining adequate insurance coverage for injuries or damages that may arise from my participation. I acknowledge that I should review my personal insurance policies and consult with my insurance providers regarding coverage.

This Agreement shall be governed by and construed in accordance with the laws of Georgia, without regard to conflict of law principles. Any legal action arising from or relating to this Agreement or my participation must be brought exclusively in the state or federal courts located in Atlanta, Georgia, and I consent to the jurisdiction of such courts.

If any provision of this Agreement is found to be unenforceable or invalid, such provision shall be severed, and the remainder of this Agreement shall remain in full force and effect. I intend for this Agreement to be enforced to the fullest extent permitted by law.

This Agreement contains the entire agreement between the parties and supersedes all prior agreements or understandings. This Agreement may not be modified except by a written instrument signed by all parties.

I EXPRESSLY WAIVE THE BENEFITS OF CALIFORNIA CIVIL CODE SECTION 1542 (and similar statutes in other jurisdictions), which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

I grant the Released Parties the irrevocable right and permission to use my name, likeness, image, voice, and biographical information in any photographs, videos, audio recordings, or other media created in connection with the Activity for promotional, marketing, or other business purposes without compensation.

I ACKNOWLEDGE THAT:

1. I have read this entire Agreement and understand its contents.

2. I am voluntarily signing this Agreement.

3. No representations or promises have been made to me other than those contained herein.

4. I understand that I am giving up substantial legal rights by signing this Agreement.

5. I have been advised to consult with an attorney before signing if I have questions about my legal rights.

I INTEND THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

I hereby grant to Henkel Corporation and its affiliates, designees, successors and assigns (“Henkel”) the unrestricted, perpetual and irrevocable worldwide right to take photographs and/or video of me and my family members (the “Photographs”), and to use and otherwise display the Photographs in whole or in part in advertisements and promotions for Henkel and its products and services, or for any other purpose. This grant includes the right, but not the obligation, (1) to reproduce, modify and/or otherwise use the Photographs or any parts thereof; (2) to use my name and other identifying information in connection with the Photographs; and (3) to display, transmit and/or otherwise exhibit the Photographs in print, electronic, and digital media, including Henkel’s intranet and internet sites and social media pages.

I warrant and represent that this license does not in any way conflict with any existing commitment on my part.

I understand that Henkel has no obligation to make any use of any of the rights granted above.

I warrant and represent that I am over the age of eighteen years, I am free to enter into this agreement, and that I have full authority to grant the rights herein.
